DRIVER TERMS & CONDITIONS

1. AGREEMENT

This Driver Terms & Conditions (“Agreement”) is entered into and shall be deemed effective as of the date of acceptance by the Driver through the DRIVERS 24/7 platform operated by RAMS Travel AppSuite LLP. This Agreement is made between RAMS Travel AppSuite LLP, having its registered office at No. 24/2, Samarpan Nilaya, 3rd Main Road, Byatarayanapura New Extension, Bengaluru – 560026 (hereinafter referred to as the “Company” or “Platform”), which expression shall, unless repugnant to the context, include its partners, successors, assigns, and permitted representatives, and the individual driver who registers and provides services through the Platform (hereinafter referred to as the “Driver”), which expression shall include legal heirs, successors, and permitted assigns.


By clicking “Accept & Continue”, digitally signing, or continuing to use the Platform, the Driver confirms that this Agreement has been read, understood, and accepted.


2. PURPOSE OF THE AGREEMENT

The Company operates a technology-enabled platform facilitating professional driver services to customers. The Platform enables registered Drivers to connect with Customers seeking driving services on a request basis. The Driver voluntarily agrees to offer such services independently through the Platform.


3. DRIVER STATUS

The Driver acknowledges and agrees that they operate as an independent contractor and not as an employee, agent, partner, or representative of the Company. Nothing in this Agreement shall be construed to create an employer-employee relationship, joint venture, partnership, or agency relationship between the parties.


4. DRIVER ELIGIBILITY & DOCUMENTATION

The Driver represents and warrants that they hold a valid and effective driving licence for the relevant vehicle category and that all documents submitted, including Aadhaar, PAN, driving licence, RC, insurance, PUC, permits, and other required documentation, are genuine, valid, accurate, and up to date. The Driver further confirms that they are medically fit, legally eligible to provide driving services, and do not have any criminal record or pending proceedings affecting eligibility. Failure to maintain valid documentation may result in immediate suspension or permanent deactivation.


5. VEHICLE STANDARDS & MAINTENANCE

The Driver agrees that any vehicle used while providing services through the Platform shall be legally registered, adequately insured, roadworthy, safe, clean, compliant with applicable laws, and maintained in accordance with Company-defined safety and service standards. Operation of a vehicle with expired, invalid, or falsified documentation is strictly prohibited.


6. APP USAGE & TECHNOLOGY COMPLIANCE

The Driver shall use only the official Driver Application and shall maintain active GPS, mobile data connectivity, and required application permissions at all times while online. The Driver shall not manipulate routes, fares, surge pricing, trip data, or booking information and shall not share login credentials or operate the account on rooted or jail-broken devices. Any misuse, tampering, unauthorised access, or technological manipulation may result in immediate suspension, permanent deactivation, forfeiture of dues, and legal proceedings.


7. DRIVER CONDUCT & SERVICE STANDARDS

The Driver agrees to maintain professional conduct at all times and shall not engage in harassment, abuse, discrimination, threats, or misconduct toward Customers or third parties. The Driver shall follow navigation guidance unless otherwise directed by the Customer, maintain vehicle cleanliness, and shall not demand additional payments or negotiate fares outside the Platform. Non-compliance may result in forfeiture of pending payments and disciplinary action.


8. SAFETY & ZERO-TOLERANCE POLICY

The Driver acknowledges that consumption of alcohol or drugs, rash or negligent driving, impersonation, account sharing, harassment, or any unsafe conduct is strictly prohibited. Violation of this policy may result in immediate suspension or permanent deactivation without prior notice and may lead to legal action.


9. TRIP HANDLING RULES

The Driver agrees to accept assigned trips promptly, avoid unnecessary or invalid cancellations, commence and complete trips strictly through the Application, and shall not request Customers to cancel bookings for personal or financial reasons. Repeated cancellations or trip manipulation may attract penalties.


10. REMUNERATION

The Driver understands that earnings are calculated on a per-trip basis and are subject to applicable platform commissions, service fees, penalties, and taxes. Incentives, if any, are performance-based, discretionary, and subject to modification or withdrawal. Payouts shall be processed as per the Company’s settlement cycle, and any disputes regarding earnings must be raised within forty-eight (48) hours of payout.


11. DRIVER REFUND & CANCELLATION POLICY

Driver-initiated cancellations shall be permitted without penalty only for valid reasons such as customer unreachability, illegal or unsafe requests, prohibited items, vehicle breakdown, emergencies, or incorrect pickup locations. Cancellations due to short trip preference, destination bias, surge manipulation, requesting the Customer to cancel, or cancelling after arrival without cause may attract penalties. In case of Customer no-show, the Driver may be eligible for a no show fee. Refund or adjustment requests shall be limited to incorrect fare calculations, missing eligible fees, technical errors, or wrongful deductions and shall not be issued for valid penalties, misconduct, fraud, or delayed disputes.


12. ACCIDENT ASSISTANCE & LIABILITY

This Agreement applies to accidents occurring during Platform trips or while en route to pickup or drop-off. In the event of an accident, the Driver shall stop safely, ensure safety of all persons involved, contact emergency services where required, promptly inform the Company or Franchise, and cooperate with authorities and insurers. The Driver may provide reasonable assistance to Customers, including facilitating emergency contact or insurance reporting; however, such assistance shall not constitute admission of fault. Liability shall be determined solely in accordance with applicable law and insurance coverage.


13. FRAUD, MISREPRESENTATION & MISUSE

The Driver shall not engage in fraudulent activities including fake trips, GPS tampering, collusion, incentive abuse, or false accident claims. Any such actions may result in immediate termination, forfeiture of earnings, blacklisting, and legal proceedings.


14. SUSPENSION & TERMINATION

The Company reserves the right to suspend or permanently deactivate Driver access for policy violations, safety breaches, fraud, misconduct, repeated poor performance, or regulatory non compliance. Severe violations may result in immediate termination without prior notice and forfeiture of pending dues.


15. LOCATION PERMISSIONS & BACKGROUND TRACKING

The Driver acknowledges that the Application collects and processes real-time location data, including in the background when the Application is closed or not actively in use, for booking allocation, trip tracking, customer updates, safety monitoring, and fraud prevention. Trip assignments are strictly location-based and rely on GPS functionality and Google Maps API integration. Enabling location permissions is mandatory to receive and accept bookings. Such location data shall not be shared with unrelated third parties except as required by law.


16. GOVERNING LAW & JURISDICTION

This Agreement shall be governed by and construed in accordance with the laws of India, and all disputes shall be subject to arbitration or courts of competent jurisdiction at Bengaluru.
